1.1 Data Controller. CreativeGrowthWorks, Muehlenweg 11, 14913 Niedergorsdorf, Germany, is the data controller responsible for the processing of personal data collected through this website.

1.2 Data Collection. We collect personal data (name, email address, phone number, company name) only when voluntarily submitted through our contact form or during project engagement. Server logs may collect IP addresses, browser type, and access times for security purposes.

1.3 Purpose of Processing. Personal data is processed solely for the purpose of responding to inquiries, delivering contracted services, and maintaining business communication. We do not sell, rent, or share personal data with third parties for marketing purposes.

2.2 Service Agreement. A binding agreement is established upon written confirmation of a project proposal or upon commencement of work following a signed statement of work. All project scopes, deliverables, timelines, and fees are defined in the applicable statement of work.

2.3 Payment Terms. Invoices are payable within 14 days of issuance unless otherwise agreed in writing. Late payments incur a statutory interest rate of 9 percentage points above the base rate. CreativeGrowthWorks reserves the right to suspend work for overdue accounts.

2.4 Intellectual Property. Upon full payment, all deliverables and work product created specifically for the client become the client's property. CreativeGrowthWorks retains the right to display work in portfolios and case studies unless otherwise agreed.

2.5 Limitation of Liability. CreativeGrowthWorks' total liability shall not exceed the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

2.6 Termination. Either party may terminate a project with 14 days' written notice. Upon termination, the client is liable for all work completed up to the termination date. Prepaid fees for uncompleted work will be refunded proportionally.

2.7 Governing Law. These terms are governed by the laws of the Federal Republic of Germany. Place of jurisdiction is the competent court at the registered office of CreativeGrowthWorks.

3.1 What Are Cookies. Cookies are small text files stored on your device when you visit our website. They help us recognize your browser and remember certain information.

3.2 Essential Cookies. CreativeGrowthWorks uses strictly necessary cookies to ensure the website functions correctly. These include session cookies for form handling and localStorage for cookie consent persistence. These cookies do not require consent under the ePrivacy Directive.

4.1 Refund Eligibility. CreativeGrowthWorks offers refunds for services not yet delivered. Once a project milestone has been completed and approved, the corresponding portion of fees is non-refundable.

4.2 Milestone-Based Refunds. Projects structured around milestones are eligible for proportional refunds on undelivered milestones. Delivered and accepted milestones are billed at the agreed rate regardless of overall project outcome.

4.3 Cancellation Refunds. If a project is cancelled by the client before work begins, a full refund of any prepaid amounts will be issued within 14 business days. Cancellations after work commencement are subject to the termination provisions in §2.6.

4.4 Dispute Resolution. Refund requests should be submitted in writing to [email protected] within 30 days of the invoice date. Disputes not resolved amicably shall be submitted to the competent court at the registered office of CreativeGrowthWorks in accordance with §2.7.

4.5 No Guarantee of Results. While CreativeGrowthWorks commits to delivering agreed-upon services with professional diligence, marketing outcomes (traffic, conversions, revenue) are not guaranteed. Refunds are based on service delivery, not performance metrics.
